Advanced Electronic Solutions Global Inc.
Limited Warranty Policy
Effective Date: August 8, 2026
This Limited Warranty Policy (the “Warranty Policy”) is issued by Advanced Electronic Solutions Global Inc. (“AES,” “we,” “us,” or “our”) and is the sole and exclusive statement of AES’s warranty coverage and return/service procedures for its products (“Products”) in the United States. This Warranty Policy is incorporated by reference into, and forms part of, AES’s Terms & Conditions of Sale and Distribution (the “Terms & Conditions”) and any AES Distributor Agreement. To the extent this Warranty Policy conflicts with the Terms & Conditions or a Distributor Agreement regarding warranty coverage, duration, remedy, exclusions, returns procedures, or disclaimers, this Warranty Policy controls. For all other subjects, including the general limitation of liability applicable to the commercial relationship between AES and a Distributor, the Terms & Conditions and the applicable Distributor Agreement control. Section 21 (Dispute Resolution) of this Warranty Policy applies only to a claim brought by a Consumer (an Installer or Homeowner); a claim brought by a Customer in its capacity as an AES Distributor is instead governed exclusively by the dispute resolution, jury trial waiver, and attorneys’ fees provisions of the applicable Distributor Agreement or, absent a signed Distributor Agreement, the Terms & Conditions.
1. Definitions
AES: Advanced Electronic Solutions Global Inc.
Customer: an active AES Distributor; where the identity of the correct Distributor is not known, this means the Installer or Homeowner in its place, in that order of priority.
Installer: an installer of access control or intercom systems working for a registered company.
Homeowner (also “end-user”): the owner of the end product.
Parties: the Customer, Installer, and/or Homeowner, considered jointly.
Product(s): the product(s) that are the subject of the sale between Customer and AES, as described in the applicable sale contract; this may be an individual component and/or a complete unit or kit.
RMA: Return Merchandise Authorization, required for all returns to AES.
Consumer: an Installer or Homeowner receiving warranty service under this Warranty Policy. “Consumer” is used interchangeably with “Installer” and/or “Homeowner” and does not include a Distributor acting in its capacity as a commercial purchaser and reseller of Products.
No-Fault-Found / Re-Test Fee: a fee of $35.00, plus applicable shipping and taxes, that may be applied to a Customer’s account, or requested from a Party that does not hold a direct account with AES, where no fault is found in a returned Product or the correct returns process was not followed.
2. Who May Rely on This Warranty Policy
2.1 This warranty attaches to, and travels with, the Product itself. AES will honor a valid warranty claim from whichever Party currently owns or possesses the Product — including the original purchasing Distributor and, in turn, an Installer or Homeowner who lawfully acquires the Product through an AES-authorized distributor or reseller — regardless of who purchased the Product directly from AES.
2.2 AES’s obligation to a Party under this Warranty Policy is limited to the remedy described in Section 9 (AES’s Obligations): repair, replacement, or, at AES’s option, a refund, subject to the coverage, exclusions, and procedures set out in this Warranty Policy.
2.3 This Section extends the warranty remedy to an Installer or Homeowner; it does not, by itself, make an Installer or Homeowner a party to, or bound by, any separate written agreement between AES and a Distributor, including the Distributor Agreement or the Terms & Conditions of Sale and Distribution.
2.4 By purchasing, receiving, installing, or using a Product, retaining a Product beyond a reasonable period after purchase without objection, or submitting a warranty or return claim to AES, a Party agrees to be bound by this Warranty Policy as the terms applicable to that Product, including the limitation of liability in Section 20, the dispute resolution procedure in Section 21, and the governing law and venue provisions in Section 24, to the extent permitted by applicable law. The current version of this Warranty Policy is available at aesglobalus.com and is made available to a Party before purchase of a Product where the Party purchases directly from AES or an AES-authorized distributor or reseller. This Section does not require a Party to waive, and does not affect, a right that cannot lawfully be waived, including as described in Section 20.3.
3. What Is Covered
THIS IS A LIMITED WARRANTY as that term is used in the Magnuson-Moss Warranty Act, 15 U.S.C. §§ 2301–2312, and its implementing regulations. AES does not offer a “full warranty” as that term is defined under the Magnuson-Moss Warranty Act for a Product covered by this Warranty Policy.
3.1 AES’s warranty is a “return to base” warranty: AES warrants that Products will conform to AES’s published specifications and be free from defects in materials and workmanship, and covers restoration of a Product acknowledged as defective due to an irregularity in the manufacturing process, through repair or replacement, at AES’s option and free of charge for the parts and labor necessary to restore conformity. A suspected defective component or item must be returned to AES’s authorized service agent for investigation and diagnosis, at the Customer’s cost to ship. Coverage is limited to a Product that has been properly installed and used.
3.2 The warranty period is 24 months (2 years) from the date of shipment of the Product from AES, as shown on the applicable AES invoice, packing slip, or other proof of purchase. If shipment-date documentation is unavailable, AES may instead determine the applicable start date using the PASSED/QC sticker, serial number, build design, or other identifying feature of the unit indicating its date of manufacture or another applicable production-period identifier.
3.3 This coverage applies to claims made to AES by a Customer, Installer, or Homeowner who purchases a genuine AES-manufactured Product from AES directly or from an AES-authorized distributor or reseller.
3.4 AES may apply an additional shelf-life allowance, currently set at 6 months, which AES may reduce, extend, or remove at its discretion and without notice.
3.5 AES may offer extended or registered warranty coverage on eligible Products through registration on AES’s website. Registration allows AES to provide improved after-sales service and may extend the standard warranty period by the length of time AES advertises at the time of registration.
3.6 Coverage extends to consumable items included with or in the Product, to the extent AES specifies for that Product.
3.7 Coverage is available to a purchaser that lawfully acquires ownership of the Product. A Party that rents or leases a Product should contact its rental or leasing company regarding the applicability of this coverage.
3.8 A claim submitted after the applicable warranty period will not be accepted under warranty but may be eligible for service under AES’s refurbishment/out-of-warranty repair program. Making a warranty claim does not extend the remaining warranty period.
4. Software Updates
4.1 AES may from time to time make software updates available online through AES’s website. It is the Customer’s or Installer’s responsibility to apply available updates and keep Product software current. AES does not treat an issue resolvable by installing a publicly available AES software update as a covered defect.
4.2 If a Product must be returned solely to perform a software update because the necessary equipment or expertise is not available on-site, AES is not responsible for shipping charges to send the item to AES.
5. Customer/Installer Obligations on Discovering a Defect
5.1 A Party that believes a Product is defective must store it appropriately, take reasonable measures to prevent further damage, and notify AES of the defect, including any apparent quality or quantity issue, no later than 30 days after the applicable purchase or discovery of the issue. The Product must be delivered or shipped to an authorized dealer or authorized service center together with the original proof of purchase showing date and Product description.
5.2 Pending return, the Party must continue to store the Product appropriately and take reasonable measures to limit further damage, and must stop using a Product reasonably believed to be defective.
5.3 Failure to provide timely notice, or continued use of a Product after discovering a defect, may be treated as acceptance of the Product and a waiver of the related claim, to the extent permitted by applicable law.
5.4 A defect that may cause further damage must be reported to AES immediately.
5.5 A returned Product must include the RMA number marked clearly on the outside of the packaging, together with a completed AES returns form.
6. Professional Installation & System Compliance
This is a professional-install Product only and is not designed, intended, or represented by AES for do-it-yourself, consumer, or other untrained installation. The Product is a component of an overall system; the Installer is solely responsible for certifying the safety and regulatory compliance of the complete, finished system. Once this Product is affixed to another item or connected to a third-party device, the Product has been incorporated into a modified system, and compliance with the applicable local regulations in the country and jurisdiction of installation is strictly the Installer’s responsibility. AES is not liable for a failure, damage, loss, or claim resulting from installation, configuration, or system integration performed other than by a qualified, properly trained professional installer, consistent with AES’s Terms & Conditions.
7. Warranty Exclusions
This Warranty Policy does not cover, and neither AES nor its authorized service agent is responsible for, any of the following:
-
Misuse or abuse, unauthorized modification, or improper storage;
-
Failure to follow AES’s published instructions or the product manual;
-
Normal wear and tear;
-
Storm damage, lightning or power-surge damage, or flooding;
-
Accidental damage, vandalism, or deliberate damage;
-
Unexplained corrosion or exposure to unusually harsh environments;
-
Failure of telephone or cellular networks, or future non-interoperability between the Product and a network provider caused by changes the network provider implements after the Product’s manufacture and that are outside AES’s control (for example, 2G/3G network shutdowns or the removal or unavailability of VoLTE service);
-
Improper, unauthorized, or unqualified installation, as described in Section 6;
-
Periodic check-ups, maintenance, or repair/replacement of parts due to normal wear and tear;
-
Cosmetic damage, including scratches and dents;
-
Costs of transport, removal, or installation of the Product;
-
Use of the Product with an accessory, charger, or supply not approved by AES, to the extent such use caused or contributed to the defect;
-
Battery damage caused by overcharging or failure to follow the product manual’s care instructions;
-
A Product whose model, serial number, or other identifying marking has been altered, removed, or made illegible;
-
A Product whose battery-enclosure or cell seals are broken or show evidence of tampering;
-
Damage from unauthorized reconfiguration of the Product (hardware or software) without AES’s prior agreement;
-
Damage to a display panel;
-
Cases where the Party declines to provide passwords or security information reasonably necessary for AES to perform warranty service;
-
Defects resolvable by installing official, freely available AES software or updates;
-
Issues resolvable by AES’s standard remote, automated, or Party-installable repair methods where the Party declines to use them without reasonable cause; and
-
Damage that visual inspection indicates resulted from an external source such as insects, lightning, or water.
Service AES performs to remedy damage or defects excluded under this Section is subject to charges for labor, transportation, and parts; re-installation of original software may also be charged.
THIS COVERAGE IS AES’S VOLUNTARY MANUFACTURER’S WARRANTY. IT PROVIDES RIGHTS IN ADDITION TO, AND DOES NOT REDUCE, ANY RIGHTS A CONSUMER HAS UNDER APPLICABLE U.S. FEDERAL OR STATE LAW, INCLUDING THE MAGNUSON-MOSS WARRANTY ACT AND STATE UNIFORM COMMERCIAL CODE IMPLIED-WARRANTY PROTECTIONS, TO THE EXTENT THOSE PROTECTIONS APPLY AND CANNOT LAWFULLY BE DISCLAIMED.
A repair not covered under this warranty may be available under AES’s refurbishment/out-of-warranty repair program; any charges will be quoted by email and/or phone, ordinarily through the distributor where possible.
8. Surge Damage
A Product showing physical signs of power-surge damage is not covered by this warranty. Such a Product will be considered for warranty coverage only if the Customer or Installer provides photographic evidence from the installation site showing that appropriate surge protection was installed and in place.
9. AES’s Obligations
9.1 AES’s sole obligation, and a Party’s exclusive remedy, for a valid warranty claim is, at AES’s option, to repair the defective Product or replace it with a conforming Product, within a reasonable time and free of charge for the parts and labor necessary to restore conformity (excluding transport, removal, or installation costs). If AES is unable to repair or replace a defective Product within a commercially reasonable period, AES may, at its option, refund the purchase price actually paid to AES for the affected Product.
9.2 Repairs or replacements may use new or refurbished parts that are functionally equivalent to the original. The warranty period applicable to a repaired or replaced item is the remainder of the original Product’s warranty period. Replaced original items become AES’s property; replacement items become the Party’s property.
10. How to Claim
Do not return a Product without first obtaining an RMA number from AES Technical Support and completing AES’s current returns form. Failure to do so may delay processing, and in some cases the Product may be returned without inspection.
10.1 A Party seeking service should contact AES Technical Support and follow the instructions given. Each request is evaluated on a case-by-case basis; AES may require reasonable troubleshooting, diagnostic information, photographs, test results, proof of purchase, installation information, configuration information, or other information before evaluating or approving a claim. Where possible, Technical Support will attempt to resolve the issue before authorizing a return and issuing an RMA.
10.2 AES may use remote access to help diagnose an issue; a Party asked to permit remote access will be asked for consent before AES or its representative accesses the Product.
10.3 Approved distributors may request a return through AES’s online portal using their assigned login. AES may withdraw access to this portal at any time and without notice.
10.4 A Product returned without first contacting Technical Support to troubleshoot or obtain an RMA will be logged with an RMA of “NONE” and may be subject to the No-Fault-Found / Re-Test Fee.
10.5 AES offers three return options, selected on the returns form. If no option is selected, AES defaults to Option A.
Option A — Repair and Return
Return a complete unit for investigation and diagnosis, to be returned to the Party. A No-Fault-Found result may incur the $35.00 No-Fault-Found / Re-Test Fee.
Option B — Advance Replacement Part
Purchase an advance replacement part and return the original part. Full credit is issued only if the returned component is confirmed to have a manufacturing defect. A No-Fault-Found result may incur a 10% re-test/re-stocking fee. Installer-damaged parts may receive no credit or may incur a repair charge. A complete unit or kit should be returned under Option C.
Option C — Full Unit Return
Return a complete unit. A restocking fee of 10%–30% applies to a complete unit returned in used or installed condition, or otherwise not in new, resalable condition, depending on the condition of the returned item, consistent with AES’s Terms & Conditions Section 13.4. This restocking fee does not apply to a unit confirmed by AES to contain a covered manufacturing defect, which is instead repaired, replaced, or refunded free of charge as AES’s exclusive remedy under this Warranty Policy. These warranty terms do not entitle a Customer to an automatic full refund. Contact AES for full details on the applicable returns procedure and restocking fee before returning a unit under this option.
10.6 Calls to and from AES may be recorded for training and quality-assurance purposes, consistent with AES’s Terms & Conditions. Where required by the law of the caller’s state (including two-party consent states such as Florida), AES will obtain the consent required before recording.
11. How to Return Items
11.1 All returns are treated as suspected defects until tested and inspected by AES. Return postage is the responsibility of the Customer, Installer, or Homeowner; AES does not provide a collection service for suspected faulty Products.
11.2 A returned Product must display the RMA number clearly on the outside of the packaging, accompanied by a completed returns form. A Product received without these, or without a valid fault description, may be delayed or returned as received.
11.3 The returning Party is responsible for packaging the Product to protect it in transit, noting the RMA number on the shipping label, including the return form inside the package, and shipping to the address provided in Section 25.
12. Processing Returns
12.1 AES is not responsible for damage to a returned electronic Product caused by static discharge resulting from inadequate packaging. Static-free packaging should be used where possible; AES’s original anti-static packaging may be reused for returns.
12.2 After receiving and testing a return, AES will process it according to the option selected on the returns form (Option A, B, or C).
12.3 AES aims to process returns within 4 business days of receipt, though this may extend up to a maximum of 28 days during busy periods, holidays, or while AES gathers information needed to complete testing.
13. Communications During the Return Process
AES will notify the Customer at various stages of the return process where possible, by email and/or phone.
13.1 Where possible, AES will relay information through the distributor or Installer.
13.2 If AES holds Homeowner contact information for a return and cannot locate the applicable distributor or Installer, AES may contact the Homeowner directly.
13.3 Parties should check spam/junk email folders for responses from AES; AES is not responsible for messages not seen due to spam filtering.
13.4 If a returned Product arrives without address or contact details, AES will make reasonable efforts to identify the distributor using the serial number. If AES cannot identify this information, AES will hold the Product for a minimum of 6 months to allow the owner to make contact, after which AES may treat the Product as abandoned and dispose of it in accordance with applicable law.
14. No-Fault-Found / Re-Test Fee
14.1 For a Customer or Installer holding an active AES account, an applicable restocking or No-Fault-Found / Re-Test Fee is applied automatically to the associated account. Fee disputes may be raised with the account’s sales manager.
14.2 For an Installer or Homeowner without a direct AES account, an applicable fee will be quoted by email or phone. If AES receives no response within 10 days, AES will return the Product in the condition received, together with a test report.
15. Refunds and Credits
AES offers a full refund only for a Product that has not been installed, is returned complete with all original packaging and manuals in new, unmarked condition, and is returned within 30 days after delivery, consistent with AES’s Terms & Conditions Section 13.2. Outside of these conditions, these warranty terms do not entitle a Customer to an automatic full refund; a returned item is instead handled under Section 10 (How to Claim) and is subject to the applicable restocking or No-Fault-Found / Re-Test Fee.
15.1 A charge required to repair a returned Product, or a No-Fault-Found / Re-Test Fee, will be communicated to the distributor or Customer through the sales manager or Technical Support.
15.2 AES will test the main functions of a returned Product, focusing on the reported issue. Where no fault is found, AES may request additional information from the Customer.
15.3 AES will contact the Customer by phone or email to communicate findings.
15.4 Where a Product is tested under warranty and no fault is found, the No-Fault-Found / Re-Test Fee may apply; AES will generally waive this fee where the Installer provided all requested information, including images, during the initial support call and the technician requested the return for further investigation.
15.5 AES will make reasonable efforts to reach the Customer to discuss findings; if AES receives no response after 10 business days, AES may return the Product as received, after collection of any applicable fee.
16. Return Delivery
16.1 Unless otherwise agreed, a Product returned by AES to a Party will be shipped by a carrier of AES’s choosing with standard insurance coverage.
16.2 AES is not directly responsible for loss or damage to a Product in transit, but will make reasonable efforts to recover available carrier compensation and pass it on to the appropriate Party.
16.2.1 Additional shipping insurance may be offered as a one-time charge or annual option where available.
16.3 The cost of standard return packaging is included in AES’s standard pricing. A Party requesting special packaging will be charged for it, where feasible.
16.3.1 AES determines the type of packaging used based on transportation requirements, except where the Party has specified particular packaging needs in its order.
16.4 AES is not liable for late delivery or non-performance caused by force majeure, consistent with AES’s Terms & Conditions Section 17, including natural disasters, labor disputes, fires, floods, epidemics, governmental action, or circumstances beyond AES’s reasonable control preventing the sourcing of labor, materials, components, energy, transportation, or required licenses.
Repairs performed under this warranty must be carried out by an AES-authorized service center. AES provides no reimbursement or warranty coverage for repairs performed by a non-authorized service center.
17. Data and Items Left in a Returned Product
17.1 AES is not responsible for a memory card, SIM card, or other storage media or property left in a Product and not removed before it is returned for service.
17.2 This warranty does not cover third-party hardware or software sold or packaged with the Product.
17.3 The Customer or Consumer is responsible for backing up and otherwise protecting its data. AES is not liable for data loss however caused.
18. Disclaimer of Implied Warranties
EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, AND AS STATED IN SECTION 7 ABOVE, ANY IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED IN DURATION TO THE TERM OF THIS LIMITED WARRANTY, TO THE MAXIMUM EXTENT PERMITTED BY LAW. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THIS LIMITATION MAY NOT APPLY TO A GIVEN CONSUMER.
19. No Additional or Unauthorized Warranty
No employee, salesperson, distributor, reseller, installer, or other representative of AES is authorized to extend, expand, modify, or otherwise alter this Warranty Policy, or to represent or imply that AES has provided any warranty, guarantee, service commitment, performance commitment, uptime commitment, installation guarantee, or other obligation beyond this Warranty Policy and applicable Product documentation, unless expressly authorized in a writing signed by an authorized AES officer.
A distributor or reseller may offer its own warranties or service commitments to its customers at its sole discretion; provided that any such warranty, guarantee, service commitment, performance commitment, or other obligation is solely the responsibility of that distributor or reseller and does not create, expand, modify, or otherwise alter any obligation of AES. A distributor or reseller offering its own warranty or service commitment shall clearly distinguish it from this Warranty Policy.
20. Limitation of Liability
20.1 To the maximum extent permitted by Florida law, this warranty is a Party’s sole and exclusive remedy against AES for a covered defect. AES is not liable for consequential, incidental, special, exemplary, or punitive damages, or for loss of profits, revenue, data, or business interruption, arising in connection with a Product.
20.2 In no event does AES accept liability, arising from a Product defect, for any of the following: the cost of attending a site; inconvenience; labor rates; time lost; loss of or damage to property; security breaches; late-payment clauses; or a breach of any contract between an Installer and its client. This Section 20.2 does not limit AES’s indemnification obligations under the Terms & Conditions or reduce a non-waivable right described in Section 20.3.
20.3 Nothing in this Warranty Policy excludes or limits AES’s liability for personal injury or death caused by AES’s negligence, for fraud, for intentional acts, for gross negligence or willful misconduct, or for any other liability that cannot lawfully be excluded or limited under applicable law. Where AES’s liability is excluded or limited, that exclusion or limitation also applies to AES’s employees, representatives, and agents.
20.4 To the maximum extent permitted by law, AES is not liable for a delay or failure in service caused by AES, its agents, employees, or contractors being hindered by circumstances beyond AES’s reasonable control. This Section does not affect a Consumer’s non-waivable statutory rights.
21. Dispute Resolution
This Section applies to a claim brought by a Consumer (an Installer or Homeowner) under this Warranty Policy. A claim brought by a Customer in its capacity as an AES Distributor is instead governed by the dispute resolution, mediation, jury trial waiver, and attorneys’ fees provisions of the applicable signed Distributor Agreement or, absent a signed Distributor Agreement, the Terms & Conditions of Sale and Distribution, and is not governed by this Section.
This Section does not require arbitration and is not intended to compel a Consumer into a mandatory arbitration process. A Consumer retains the right to pursue its claim in a court of competent jurisdiction as described in Section 24 (Governing Law and Venue), or in small claims court where the claim qualifies, subject to the procedure below.
21.1 Before filing a lawsuit relating to a claim under this Warranty Policy, a Consumer shall first give AES written notice describing the claim, including a reasonable description of the Product, the issue, and the relief sought, and shall allow AES 30 days from that notice to investigate and respond before filing suit. This requirement does not apply to a claim filed in small claims court, or to a request for emergency or injunctive relief necessary to prevent irreparable harm.
21.2 If the claim is not resolved after the notice period in Section 21.1, either AES or the Consumer may pursue mediation with a mutually agreed mediator, or may proceed directly to the court described in Section 24.
21.3 JURY TRIAL WAIVER — PLEASE READ CAREFULLY. THIS WAIVER APPLIES TO A CONSUMER (AN INSTALLER OR HOMEOWNER); A CUSTOMER’S JURY TRIAL WAIVER IN ITS CAPACITY AS AN AES DISTRIBUTOR IS GOVERNED BY THE APPLICABLE DISTRIBUTOR AGREEMENT OR TERMS & CONDITIONS. TO THE EXTENT PERMITTED BY APPLICABLE LAW, A CONSUMER KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THIS WARRANTY POLICY OR A PRODUCT. THIS WAIVER IS A SEPARATE AND DISTINCT TERM FROM THE OTHER TERMS OF SECTION 2.4 AND IS MATERIAL TO AES’S DECISION TO PROVIDE THE WARRANTY COVERAGE DESCRIBED IN THIS WARRANTY POLICY. A CONSUMER THAT DOES NOT AGREE TO THIS WAIVER SHOULD NOT PURCHASE, INSTALL, OR USE THE PRODUCT, AND MAY CONTACT AES USING THE INFORMATION IN SECTION 25 BEFORE DOING SO WITH ANY QUESTION ABOUT THIS WAIVER.
21.4 Except to the extent limited or superseded by a specific applicable federal statute governing the claim — including the one-way fee-shifting provision of the Magnuson-Moss Warranty Act, 15 U.S.C. § 2310(d)(2), which permits a prevailing consumer, but does not permit AES, to recover attorneys’ fees and costs in a claim brought under that Act — the prevailing party in a dispute between AES and a Consumer arising under or relating to this Warranty Policy is entitled to recover its reasonable attorneys’ fees and costs from the non-prevailing party, to the extent permitted by Florida law. This Section 21.4 does not apply to a dispute between AES and a Customer in its capacity as an AES Distributor, which is instead governed by the applicable attorneys’ fees provision of the Distributor Agreement or Terms & Conditions.
22. Severability
If a court or other authority of competent jurisdiction determines that a provision of this Warranty Policy, including the jury trial waiver in Section 21.3 or the attorneys’ fees provision in Section 21.4, is invalid or unenforceable as to a particular Party or in a particular jurisdiction, that determination shall not affect the validity or enforceability of the remaining provisions of this Warranty Policy, or the enforceability of that same provision as to another Party or in another jurisdiction, and this Warranty Policy shall otherwise remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intended purpose, or, if it cannot be so modified, shall be severed from this Warranty Policy.
23. Amendments
AES may modify this Warranty Policy upon reasonable notice, including by posting an updated version on AES’s website. Coverage, remedy, and exclusion terms applicable to a given Product are those in effect on the date of shipment of that Product from AES and are not reduced by a later amendment, unless required by applicable law. The RMA, returns-processing, and fee procedures in this Warranty Policy apply as in effect on the date a Party submits the applicable return or claim.
24. Governing Law and Venue
This Warranty Policy is governed by the laws of the State of Florida, without regard to conflict-of-law principles, consistent with the governing law provision of the Terms & Conditions. Exclusive venue for a dispute arising out of or relating to this Warranty Policy lies in the state courts of Brevard County, Florida, or the United States District Court for the Middle District of Florida.
25. AES Contact Details
The current version of this Warranty Policy is available on AES’s website and upon request to AES customer support.
